THIS JUST IN: Rob Ford remains mayor after winning appeal
A Divisional Court panel of judges has ruled in favour of Rob Ford’s appeal in a conflict-of-interest case, which means he can remain as mayor.
Last November, Ontario Superior Court Justice Charles Hackland ordered Ford out of office for violating the Municipal Conflict of Interest Act. Ford had participated in a council vote on whether he should repay money he had solicited for his private football charity using city resources. -
Conclusion
[96] In light of our conclusion that Decision CC 52.1 was a nullity because of the nature of the financial sanction it imposed, the appellant has not contravened s. 5(1) of the MCIA. Therefore, the appeal is allowed, the judgment of the application judge is set aside and the application under the MCIA is dismissed. -

Sorry, Steve, I haven't read the full ruling. It is in the hands of our Kevin Misener over at city hall, but I think at some level the panel ruled that the original ruling by Justice Hackland was nullified "because of the nature of the financial sanctions it imposed " - in other words, the law was a blunt instrument that was not designed to be applied to the relatively insignificant amount of money involved. -

I'm HAPPY for Rob Ford!! This should let all Torontonians, that our elected officails like to waste time!!! Why can't they all just act like adults & do their jobs in which they were elected to do?? Stop picking on him, do your jobs & just get on with it. I define this as a term of "Bullying" and our kids who go to school get punished for this such treatments, we may want to consider doing this to those who have time to waste on the board!! Rob Ford was innocent all along. It was all the leftists trying to kick him out. But they failed. If it had been any other mayor in this situation there would not have been such a push to get him out. But FORD succeeded and he will succeed again in 2014. The leftists can't stop FORD NATION!!!!! Good News for the citizens of Toronto. People make mistakes throughout their lives that are more serious than the one that Rob Ford did. We were able to avoid a costly $7 Million election. The monies saved can now go to areas that really need them in Toronto. -

Unhappy about this. The original decision was a good one. Mayor Ford should have been removed from office. Not that I wanted a byelection, but anyone but Ford. This city needs a mayor who is committed to the city as a whole, not just the right-wing, football playing portion. -

There was no issue for him helping his private football team. However, the problem is that he should have used his own money, not taxpayers. When I give money I then out of my own pocket, that is the christian thing to do. You don't take money from other people and give their money, who does this definitely not the moral or christian thing to do. Hope he now knows the laws, maybe he should actually polish up on them, so he can't use another excuse next time he does something wrong. When us little people are charged for something we have done wrong they are told "Ignorance is no excuse for the law", why is it okay for Rob Ford. Just because he won doesn't mean he was right in what he did. He should not only pay back the money but he should be fined. It doesn't surprise me that he got off. It tells us all that if you know the right people and you have money then you can get away with anything. I am sure that he didn't fight this charge using his own money either. What a sad world we live in. -

Even though I don't currently live in Toronto,this is still the person I woud want in office, he is far from perfect, but that said, so are all politians. His biggest mistake is he needs a better P.R person. His +++ outweigh his ----, he is running Toronto like the business it is and making great head way, GO FORD GO!!!! -

I am disappointed that people say that they are disappointed and that the Mayor "violated the law." We do live in a common law society and not a civil law society and therefore a judge rules based upon their interpretation of the law and not always by the letter of the law. If a judge stretches their interpretation beyond what's reasonable it will most likely be overturned because of flawed reasoning. Simply put if you hate the mayor, you hate the mayor, but don't say that the ruling was wrong because you wanted to see him out of office. It happens that lower court judges err in their judgment as was the case here, that's why appellate courts have three judges to ensure fair hearing. -
This is unfortunate as it demonstrates that Rob Ford is above the law. It's not a 'left' or a 'right' thing - the fact that people use that kind of rhetoric is exactly why Ford is not good for Toronto. He should be for Toronto, and it's people, not some particular political leaning. -

Rob Ford violated an existig law. The fact we question the clarity or validy of the law is irrelevant. Is Giorgio Mammoliti changing sides again? He moved to Fords camp as son as he won, resigned from the inner circle as soon as he was found guilty and now defends Ford again? -

I agree at least he is wrong to use a letter head and his power to use it to help his football team, and he has an attitude problem with the rule, and that's why he goes through this lesson (which paid by us taxpayers). But for judgement on punishment, the judge can give out judgement that is benefit to the society (like what good thing he has done to the city of Toronto). I think our position is Mayor Ford is guilty of abusing the rule and law, but he might not deserve out of the office. -

The Judges have error on this ruling.
What the Public and the Judges have to realize is that the original ruling was that Councilor Rob Ford at the time had made a mistake of using City Letterhead to write to potential Donors to HELP KIDS.
I’m sure most politicians have done the same while in office. Council gave him a slap on the wrist for his action; however, Rob Ford did not accept the slap on his wrist and reopened this after he was MAYOR.
While he was MAYOR he participated in the Council meetings to discuss this action, it was very clear to most Torontians that he was in Conflict of Interest. MAYOR Ford tries to use his position to benefit himself at this point.
This is wrong and it does not matter if it is the Mayor of MISSISSAUGA, WINDSOR, LONDON or TORONTO. The courts must not consider the effect of the appeal process on the people when deciding if Mayor FORD was in conflict of Interest.
If the courts allow this to be overturn, then the People of TORONTO, ONTARIO and CANADA are not being protected.
This is not the first time that Rob FORD has been in trouble for his actions, and each time he seems to be able to get off. Why are there 2 rules in this City, Province and Country?
The best way to stop these actions from happening time and time again is to up hold the Courts ruling and show politicians that they are not above the LAW. -
